Records requested:

1) Any and all Manchester Township reports filed regarding the unlawful detainment of two photographers engaged in First Amendment protected activity outside the Lakehurst Naval Air Station by Manchester Township Police Sgt. Sharry and other police officers on 05/20/2017.

2) A list of all Manchester Township police officers by rank, name and badge number on scene during the above described event.

3) Any and all available records pertaining to the internal affairs investigation initiated on or about 05/30/2017 regarding the unlawful detainment of photographers in the above described event.

4) Any and all available records pertaining to the findings of the above described internal affairs investigation concluded on or about 08/21/2017 which allegedly concluded that Manchester Township Police Sgt. Sharry and other police officers involved acted inappropriately, violated department policy, and violated the Constitutional Rights of the photographers who were unlawfully detained, and/or subsequent findings of police misconduct regarding this incident.

5) Any and all records pertaining to training conducted in response to the above described internal affairs investigation and/or subsequent findings of police misconduct regarding this incident, and a roster of those who received the training.

6) Any and all information regarding Manchester Township Police Department policy regarding response to public photography.

7) Any and all information regarding Manchester Police Department policy regarding police officers identifying themselves when requested by citizens.

8) Any and all township committee meeting minutes regarding the above described matters.

I would just like to verify that this email is in response to an OPRA request dated March 21, 2018 and sent to Municipal Clerk Sabina Skibo on the same date. Please be advised that the Manchester Municipal Offices were closed on Wednesday, March 21, 2018 and Thursday, March 22, 2018 due to inclement weather. The offices were further closed on Friday, March 30, 2018 in observance of Good Friday. The deadline to respond to this request is Tuesday April 3, 2018. As such, a two week extension of time is needed to fill this request. The documents will be available Monday, April 16, 2018.

report dealing with the incident in question.  Please notice that the
person listed in the report, was not charged with any offense, therefore
under OPRA law his privacy is protected and redacted in this case.

badge number on scene during the above described event. - We are not
required to compile a list, as the requestor has requested.  However, this
information is clearly provided in the police report listed in Request
#1.  Confirmed by legal counsel.

 

3) Any and all available records pertaining to the internal affairs
investigation initiated on or about 05/30/2017 regarding the unlawful
detainment of photographers in the above described event. - See legal
opinion provided by legal counsel on the release of Internal Affairs
report.

 

4) Any and all available records pertaining to the findings of the above
described internal affairs investigation concluded on or about 08/21/2017
which allegedly concluded that Manchester Township Police Sgt. Sharry and

policy regarding response to public photography. - Provided, same
information from Request #5

 

7) Any and all information regarding Manchester Police Department policy
regarding police officers identifying themselves when requested by
citizens. - Policy enclosed.

 

8) Any and all township committee meeting minutes regarding the above
described matters. – All minutes are on the Township website, you may find
them at [1]www.manchestertwp.com, please look under Towns Council. All
approved minutes are available.
