Stephen Reid Communication on Sporting Complexes

We're waiting for John Zimmerman to read a recent response and update the status.

Dear Jackson Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested: All text and email communications from Stephen Reid and Stephen Reid Associates to and from Mayor Reina pertaining to the lobbying and public relations of any and all present, future and proposed sports and sporting complexes in the town.

Dear Mr. Zimmerman:

Please accept this email as a follow-up to your OPRA request.  Please be
advised that your request is overly broad and must be clarified.  You have
failed to properly identify (with reasonable clarity) the specific record
you are seeking copies of.  Requesting copies of "any/all" records (as
noted below items 1) is overly broad.  Please clarify and re-submit your
request.  A requestor must specifically describe the document sought. Bent
v. Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005). 
As such, a proper request under OPRA must identify with reasonable clarity
those documents that are desired, and a party cannot satisfy this
requirement by simply requesting all of an agency's documents. 

 

 1. 1. Any and all present, future and proposed sports and sporting
complexes in town.

  In conclusion, OPRA is not intended as a research tool to “force
government officials to identify and siphon useful information.  Rather,
OPRA simply operates to make identifiable government records ‘readily
accessible for inspection, copying, or examination.’ MAG Entertainment,
LLC v. Division of Alcoholic Beverage Control, 375 N.J.Super. 534, 546
(App. Div. 2005). The Court further held that "[u]nder OPRA, agencies are
required to disclose only ‘identifiable’ government records not otherwise
exempt ... In short, OPRA does not countenance open-ended searches of an
agency's files." Id. at 549.

Dear Danielle Sinowitz,

My response requesting emails and texts From Stephen Reid to and from Mayor Reina was not overly broad, because it specifically requested only those messages pertaining to past, present and future sporting complexes in town, which is in itself very focused and specific.

That said, I am aware that Stephen Reid has been lobbying Mayor Reina about this project and as such, that information should be fully accessible to the public. If you would like me to clarify further, I would be happy to do so. Please include any and all emails from [email address] containing the words "sport", "Aquatecture", "Trophy Park", "Adventure Crossing" and "Vito" to and from Mayor Reina's personal and private email addresses. Please also include all text messages from 732-740-6514 to and from Mayor Reina's cell phone. Please query February 28, 2018 to February 28th, 2019.
