Dear Atlantic County,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

E-mail logs for Sheriff Eric Scheffler and Chief Warrant Officer Timothy Reed from July 15, 2020 to October 1, 2020.

E-mail logs will provide a comprehensive list of dates, subjects, senders, and recipients for the date range specified and will include all incoming and outgoing e-mail logs to and from Timothy Reed and Eric Scheffler’s county e-mail accounts.

Please provide in PDF format if possible, as a similar request in the past had issues with Excel data input stemming from the County of Atlantic’s method of data entry.

Yours faithfully,

Anonymous

CUSTODIAN RESPONSE TO OPRA REQUEST  462-2020

October 7, 2020

You have submitted an Open Public Records Act (OPRA) request and indicated
that your preferred delivery method is email.

Your request seeks: E-mail logs for Sheriff Eric Scheffler and Chief
Warrant Officer Timothy Reed from July 15, 2020 to October 1, 2020. E-mail
logs will provide a comprehensive list of dates, subjects, senders, and
recipients for the date range specified and will include all incoming and
outgoing e-mail logs to and from Timothy Reed and Eric Scheffler’s county
e-mail accounts.

Attached please find the documents responsive to your request.  Please be
advised that the following have been redacted pursuant
to N.J.S.A. 47:1A-1: telephone numbers.

N.J.A.C. 47:1A-1 states:

Privacy Interest – “a public agency has a responsibility and an obligation
to safeguard from public access a citizen’s personal information with
which it has been entrusted when disclosure thereof would violate the
citizen’s reasonable expectation of privacy.”

Burnett v. County of Bergen, 198 N.J. 408 (2009).  Without ambiguity, the
court held that the privacy provision “is neither a preface nor a
preamble.”  Rather, “the very language expressed in the privacy clause
reveals its substantive nature; it does not offer reasons why OPRA was
adopted, as preambles typically do; instead, it focuses on the law’s
implementation.”  “Specifically, it imposes an obligation on public
agencies to protect against disclosure of personal information which would
run contrary to reasonable privacy interests.”

Please note, the documents are in the Excel format because converting the
documents to PDF would remove information which you requested. Please let
me know if you cannot open these documents for any reason.

Sincerely,

Rachel K. Goloff, Esq.

Dear Goloff_Rachel,

Thank you for quickly fulfilling this request. The request seeks all e-mail logs for both listed individuals for incoming and outgoing messages, not just the e-mails to each other. Thank you for considering this clarification of the request.
