Request for Direction for Drafting of Letter and Services Utilized for Delivery

Dear Piscataway Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested:

I am requesting the documentation specifically regarding municipal direction given to township Contractor Hogland, Longo, Moran, Dunst & Doukas, LLP to draft a letter to resident Piscataway resident Evan Shegoski as a private citizen at his home residence in regards to the provision of EMS services at Piscataway's 2021 4th of July Celebration held in September of the same year.

In addition to direction given to the contractor to draft this letter, I am requesting a copy of the said letter which was dated August 24, 2021 and documentation of it's delivery (ie. USPS receipt or equivalent documentation from service hired).

Further, I am requesting records of all costs incurred to the Township in this matter.

Good Afternoon, 
 
Attached please find the documents responsive to your OPRA request
for Direction for Drafting of Letter and Services Utilized for Delivery.  
 
Attached are the correspondence requested dated August 24th. The Township
Attorney is unable to locate the certified mail receipt, however also
attached is Mr. Shegoski's correspondence confirming receipt of same and
including a response to the August 24th letter. 
 
In regard to the request for "the documentation specifically regarding
municipal direction given to township Contractor Hogland, Longo, Moran,
Dunst & Doukas, LLP to draft a letter to resident Piscataway resident Evan
Shegoski as a private citizen at his home residence in regards to the
provision of EMS services at Piscataway's 2021 4th of July Celebration
held in September of the same year." Please be advised that all records
that would be responsive to this request would fall under the Attorney
Client Privilege GRC Exemption No. 7 and therefore will not be provided..
See also Meakem v. Borough of Pompton Lakes, GRC Complaint No. 2003-66
(March 2004). 
 
In regard to the request for "costs incurred by the Township in this
matter." Your request requires additional time beyond the seven (7)
business days to fulfill. OPRA allows custodians to seek extensions of
time pursuant to N.J.S.A. 47:1A-5.i.  Specifically, OPRA states that, “the
requestor shall be advised by the custodian when the record can be made
available. If the record is not made available by that time, access shall
be deemed denied.”  
 
The remainder of your request requires an extension of time until March 7,
2022.

Dear Kelly Mitch,

Thank you for the information provided so far and thank you for the expiation on limitations of information that can legally be provided.

In lieu of receipt of certified delivery, I’d like to request that you specifically include a copy of the postage that was billed to the Township’s account for this certified delivery.

As this portion has yet to be completed and whereas this information specifically relates to the outstanding portion of this request, it is reasonably understood that this is not an additional request but rather a clarification given new information provided.

Good Afternoon,
 
Enclosed is the legal fees report in response to your request. Please note
that the 2.00 hours are not only for this matter, but as can be seen,
substantial portions of the time from August 23^rd was allocated to work
on other matters and therefore those fees would not be applicable to the
matter requested.
