Good Morning:
The Office of the Clerk of the City of Newark has assigned your request
tracking number PD-23-0081 and forwarded it to the Police Division.
Note that the Office of the Clerk is not the custodian of record for any
court system and therefore would not have any records of court records
such as complaints, indictments, and the like.

Government agencies properly extend OPRA's initial seven-business day
deadline for good cause when the extension comes within the first seven
business day deadline and provides a date certain by which the request
will be filled. The requestor's consent to the extension is not
necessary. Starkey v. Dep't of Transportation, GRC 2007-315, 2007-316,
2007-317 (2009). Rivera v. Plainfield, GRC 2009-317 (2011). Criscione v.
Gutenberg, GRC 2010-68 (2010).   

  

In order to gather the documents responsive to your requests, the OPRA
unit sends your requests to the respective City Departments, which
actually created, received, or retained these documents. Since the State
of Emergency, crucial City Staff have retired, become sick, and work a
staggered schedule, which makes the time needed to gather responsive
documents far longer than usual.  

This office received your request on Jan. 11, 2023, and anticipates a
response on or about Feb. 14, 2023.

Good Morning:
The Office of the Clerk of the City of Newark has received the attached
response from the Police Division. The Police Division does not have any
documents related to the incident for which Union County Police arrested
him. The Law Department is currently reviewing Mr. Formisano's Internal
Affairs file to determine those portions of his Internal Affairs file, to
which you have access under the common law. The attached cover letter
