I am in receipt of your OPRA request that was originally emailed to the
Township of Berlin however please note that the address that you are
referencing is in the jurisdiction of the Borough of Berlin.


In response to your original request of 04/24/2020, I am unable to comply
with your request for the following reason(s):


-          Request of “Any and all” is overly broad and unclear pursuant
to MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375
N.J. Super. 534 (App. Div. 2005), Bent v. Stafford Police Department, 381
N.J. Super. 30 (App. Div. 2005), New Jersey Builders Association v. New
Jersey Council on Affordable Housing, 390 N.J. Super. 166 (App. Div.
2007), and Schuler v. Borough of Bloomsbury, GRC Complaint No. 2007-151
(February 2009).

-          A custodian of records is not required to research files in
response to a request pursuant to Donato v. Township of Union, GRC
Complaint No. 2005-182 (February 2007).

-          As per OPRA guidelines and N.J.S.A. 2C:25-33 “Prevention of
Domestic Violence Act of 1991” states that all records maintained pursuant
to this act shall be confidential and shall not be made available to any
individual or institution except as otherwise provided by law.
