Police Internal Affairs Summary Report

John Paff made this OPRA request to Trenton City

Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

The request was successful.

Please accept this as my request for government records under both OPRA and the common law right of access. Thank you very much for your commitment to transparent government.

RECORDS REQUESTED:

The Trenton Police Department's 2022 annual "report summarizing the types of complaints received and the dispositions of those complaints" as required by the Internal Affairs Policies & Procedures (IAPP) Section 9.11.1. It should be in the form of IAPP Appendix K.

In lieu of sending me the Appendix K, Trenton may satisfy this request by a) uploading it to its webpage and b) notifying me, via OPRAMachine, that it has done so. I would actually prefer this because it would make those important reports available to everyone in the public, not just me.

Dear John Paff,

The official Records Custodian has received your request on 02/23/2023.

As such, the seven (7) business day deadline to respond to your request is
03/07/2023.

The request seeks access to the following:

The Trenton Police Department`s 2022 annual `report summarizing the types
of complaints received and the dispositions of those complaints` as
required by the Internal Affairs Policies & Procedures (IAPP) Section
9.11.1.  It should be in the form of IAPP Appendix K.

DUE TO EMERGENCY STAFFING LEVELS IN THE CITY CLERK’S OFFICE THE CITY OF
TRENTON DOES NOT, IN SOME CASES, HAVE THE ABILITY TO MEET THE SEVEN
BUSINESS DAY DEADLINE FOR OPRA REQEUSTS.  WE ASK FOR YOUR PATIENCE DURING
THIS EMERGENCY.  YOU HAVE THE OPTION OF FILING A COMPLAINT WITH THE
GOVERNMENTAL RECORDS COUNCIL OR THE NEW JERSEY SUPERIOR COURT.  WE ASK
THAT YOU GIVE US THE EXTRA TIME TO PROCESS YOUR REQEUSTS, HOWEVER DUE TO
EMERGENCY STAFFING LEVELS IT IS NOT POSSIBLE TO MEET THE DEADLINE IN SOME
CASES.  WE WILL RETURN TO NORMAL DEADLINES WHEN THE EMERGENCY IS ABATED.
THANK YOU.

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the City of Trenton to deny access. At
your option, you may either institute a proceeding in the Superior Court
of New Jersey or file a complaint with the Government Records Council
(GRC) by completing the Denial of Access Complaint Form.  You may contact
the GRC by toll-free telephone at 866-850-0511, by mail at P.O. Box 819,
Trenton, NJ, 08625, by e-mail at [email address], or at their web site
at www.state.nj.us/grc. The GRC can also answer other questions about the
law.  All questions regarding complaints filed in Superior Court should be
directed to the Court Clerk in your County.

Sincerely,

Dear Clerk Garcia:

I note that your office inserts this text into your OPRA acknowledgements:

WE ASK FOR YOUR PATIENCE DURING THIS EMERGENCY. YOU HAVE THE OPTION OF FILING A COMPLAINT WITH THE GOVERNMENTAL RECORDS COUNCIL OR THE NEW JERSEY SUPERIOR COURT. Regardless of your staffing levels, I believe that the City is required to at least respond to each OPRA request received within the seven business-day period and inform the requestor with a date by which he or she will receive a proper response. See pp 17 and 18 of the GRC's Custodian's Handbook (Seventh Edition - Updated November 2022).

Thank you.

John Paff

Dear Mr. Garcia:

I see that you're trying to provide me with file called "2023472052_Appenedix_K_Annual_Report_2022.pdf" to satisfy my request. However, none of the links allow me to download this file. Could you please resend it?

Thank you.

John Paff

Because I didn't get the requested document, I sent the following through Trenton's online OPRA portal on May 1, 2023. My request was assigned Ref #. OPR-2023-00797
--------------------
Please accept this as my request for government records under both OPRA and the common law right of access. Thank you very much for your commitment to transparent government.

BACKGROUND:

On February 22, 2023, I made an OPRA Record that was assigned Reference # OPR-2023-00328. Trenton apparently tried to send me a file called "2023472052_Appenedix_K_Annual_Report_2022.pdf" to satisfy my request. However, none of the links that OPRAMachine gave me actually allowed to open the file. On March 18, 2023, I sent in a follow-up via OPRAMachine but I haven't yet received a response. Accordingly, I'm making this request, directly via Trenton's portal instead of through OPRAMachine so that I can get the file I requested.

RECORDS REQUESTED:

The Trenton Police Department`s 2022 annual report summarizing the types of complaints received and the dispositions of those complaints` as required by the Internal Affairs Policies & Procedures (IAPP) Section 9.11.1. It should be in the form of IAPP Appendix K. This should be the document that you previously attempted to send me through OPRAMachine, referenced above.

Trenton responded to my OPRA request and provided me with the 2022 Internal Affairs Summary Report (Appendix K) which is available at the link below:
