I am not in the area at the moment, but am researching two properties, so thank you for sending the deeds. I need a few more deeds, and will split them into several OPRA requests so as not to request too many at once. I am sending this to you directly since OPRA Machine does not have a page for the Sussex County Clerk's Office. If I need to submit this through the Sussex County OPRA Machine link like I did with the first one, please let me know and I will do so, but I figured this was faster and would get to your email quicker.

Please note that our records are exempt from OPRA, as they are public
records and are readily open and available to the public for searching.

Our staff provided you with the documents you requested under OPRA as a
one-time courtesy. If future copies are needed, you will have to make a
written request, providing the exact book and page references that should
be copied, and our staff will make those copies for you once the
appropriate fees have been collected.

The statutory fee for copies is $2.00 per page. It is preferred that you
provide our office with one complete list as opposed to several partial
lists. After the list is reviewed and we ascertain the complete number of
pages to be charged, we can email you the amount to be paid. Payment will
have to be made by check or money order, as we are unable to accept credit
card payments.

Deeds are not exempt from OPRA. Please review these specific items on https://www.nj.gov/grc/public/faqs/ which confirm my request is indeed an OPRA request.

"OPRA specifically defines a government record as: "... any paper, written or printed book, document, drawing, map, plan, photograph, microfilm, data processed or image processed document, information stored or maintained electronically or by sound-recording or in a similar device, or any copy thereof, that has been made, maintained or kept on file ... or that has been received in the course of his or its official business ..." (Emphasis added.) N.J.S.A. 47:1A-1.1.

Generally stated, a "government record" means any record that has been made, maintained, or kept on file in the course of official business, or that has been received in the course of official business.

"OPRA provides that a custodian must permit access to a government record and provide a copy of the record(s) in the medium requested, if the public agency maintains the record in that medium."

"A custodian must grant access to a government record by the method of delivery requested by the requestor (such as regular mail, fax, or e-mail). OPRA permits the production of electronic records free of charge"

"Is there a fee to convert records to a specific medium? Example 1: A requestor wants a record sent via e-mail. The Custodian must scan a paper document to convert it to electronic format. The request takes the Custodian 5 minutes to complete. No charges apply."

"Can the custodian provide on-site inspection but deny copies of records requested? No. If a record is subject to public access under OPRA, the record is available for public inspection as well as copying."

As you may know, Sussex County land records from 1950 to the present are
available online for your convenient inspection on the County Clerk’s
webpage. Land records prior to 1950, such as the two deeds you are now
requesting, are not viewable online, but are available for public
inspection/viewing in the Records Room of the Sussex county Clerk’s Office
which is open during normal business hours and extended hours to 6pm on
the first Monday of each month (excluding holidays).

 

If it is inconvenient for you to visit our Records Room to search for
older records, the Clerk’s Office staff can produce copies for you at the
fee authorized by statute of $2.00 per page, NJSA 22A:2-29.  The OPRA
statute in Section 5(b) provides that “[e]xcept as provided by law or
regulation, the fee assessed for the duplication of a government record
embodied in the form of printed matter shall be $0.05 per letter-sized
page or smaller, and $0.07 per legal-size page or larger,” NJSA
47:1A-5(b).  The deeds recorded prior to 1950 as in the instruments you
are requesting, are ancient deeds not maintained online. Fulfilling your
request will require a statutorily authorized service of the Sussex County
Clerk’s Office in locating the requested deeds, some of which are among
physical hardbound volumes of ancient deeds, making paper copies of the
deeds, and scanning them into the computer so that they can be emailed to
you.

 

You can avoid these modest copying fees at your option, by coming to the
Sussex County Clerk’s Office and copying/printing the deeds yourself,
using the copying machine in the records room at a $.05 per-page charge
for regular copies or $.07 per page for legal size.

 

The following request you have made consists of a total of 16 pages:
