Dear B. Saint-Jean B. Saint-Jean,
Thank you. We have received your OPRA request. The Town of Kearny will
make any effort to respond in a timely manner during this crisis.
On March 20, 2020, New Jersey Governor Phil Murphy took action modifying
the deadline by which public agency is required to respond to requests for
government records during a period of emergency.
Please see NJ Bill A-3849/S-2302, Page 5, line 30:
"During a period declared pursuant to the laws of this State as a state of
emergency, public health emergency, or state of local disaster emergency,
the deadlines by which to respond to a request for, or grant or deny
access to, a government record under paragraph (1) of this subsection or
subsection e. of this section shall not apply, provided, however, that the
custodian of a government record shall make a reasonable effort, as the
circumstances permit, to respond to a request for access to a government
record within seven business days or as soon as possible thereafter."
Therefore, please be advised that the Town will respond to requests as
soon as practicable under the circumstances.
Sincerely,
The Town of Kearny

W005750-071720-OPRA Request
Dear B.Saint-Jean:
The Town of Kearny and the official Records Custodian, Patricia Carpenter,
received your Open Public Records Act (OPRA) request on July 17, 2020.
This response to your request is being provided to you on the 1st business
day after the custodian’s receipt of said request.
Your OPRA request sought access to the following:
A current list of records over the past 2 YEARS for each of the following
be delivered via e-mail in EXCEL format:
1) All abandoned/vacant residential properties (Property Class 2)
2) All condemned properties
3) All residential properties with delinquent taxes
4) All residential properties for which a Lis Pendens notice has been
filed or that are currently in probate
5) All properties that are absentee-owned
6) All properties with delinquent water and sewer which date back up to 1
year, including amounts owed
7) All properties currently listed with water shut-off notice
8) All properties with code violations, including the type of violation
9) All properties with notices of abatement
Currently, your request fails to identify with reasonable clarity the
specific government records sought, as is required by Bent v. Stafford
Police Department, 381 N.J.Super. 30, 37 (App. Div. 2005). At this time,
we request clarification of your OPRA request. Please be advised that
your OPRA Request is overly broad and requires clarification, a request
that includes "any" or "all" is overly broad.
In effort to provide records responsive to your OPRA Request, attached
please find record responsive the currentabandoned/vacant property list
(#1). The Construction Code Department Official, Tony Chisari advised
there is no way togenerate a spreadsheet of “All” properties with
outstanding code violations(#8). Additionally, The Construction Code
Department advised the rest of this request would not be Construction Code
Department records, and per review, may notbe records responsive kept by
departments in the Town of Kearny.
The Tax Assessor, John Peneda has also reviewed your request and advised
that request for item listed (#9) is also overly broad and requires
clarification in terms of "All" properties with notices of abatement.
Please respond in writing and identify the specific government records
sought so that we may process your request. Failure to provide written
clarification of your request by July 24, 2020 will result in the closure
