This is a request for public records made under OPRA and the common law right of access. I certify under penalty of NJSA 2C:28-3 that I have not been convicted of an indictable offense. Please acknowledge receipt of this message.

This request is to clarify my previous request for communications from NJDEP to Stockton University on behalf of the publicly funded research project about Martin Luther King and his connections to Camden, NJ. I am requesting all emails, faxes, ,memos and letters sent or received between Bob Craig, Kate Marcopul, Doug McVarish, Andrea Tingey and John Hazen and any other employee of NJDEP, between themselves, and any official at Stockton University including but not to, Paul Schopp, John Ohara, Michelle McDonald and any other unnamed Stockton Employee or student working on thie research project, as well as the Office of the Mayor of Camden, including but not limited to, Dana Redd, Robert Coralles, Vincent Basara, Novella Henson or any other unnamed employee, in reference to the publicly funded MLK in Camden research project, between the dates of August 1st of 2016 through December 8th of 2017.

Yes, Matt did contact me, but I prefer to use this method of communication so a public record can be kept by a third party. He told me that they have over 4000 emails, 1547 electronic communications and 1.5 cubic feet of hard copy documents all having to do with this project and that I needed to limit my scope or it would be denied. Here is what I agree to: Send me all of the emails and electronic communications, I don't need the hard copy stuff at this point. Please let me know if you are agreeable to this amended request?

What is the difference between the emails and the electronic communications? What exactly are electronic communications?

I am willing to accept the emails/communications from the dates of 1-1-2015 through 8-31-2015 along with the ones from 6-1-2016 through today. That should limit the scope quite a bit.

Also, I asked the DEP to provide me with the information on the bid procurement but I haven't heard anything as of yet from them. Could you help find me where this bid was properly advertised and what steps were taken to procure the vendor, such as the original bid submitted by Stockton, attempts to procure other bids and any price negotiation on the single bid received?

Please let me know if you are agreeable to my amended request?

I will respond separately to this email and the associated one received today in order to properly address your concerns and provide clarification.

With regards to this email, clarification was requested due to the wording of your request that captured all Historic Preservation Office's (HPO) project records on the Martin Luther King house. The search for records resulted in the identification of 4,180 potentially responsive emails and 1,547 electronic files on the NJDEP servers. The NJDEP has an obligation to review and withhold or redact privilege/confidential records pursuant to OPRA. The review of these records would result in a substantial impact to NJDEP resources as knowledgeable individuals on the project would be task to review the records for privilege and such resources are limited. A guestimate of amount of time to review this voluminous amount is approximately 96 Hours. This does not include the hardcopy records.

The dedication of a knowledgeable individual HPO resource or DAG for a 3-week period of time would substantially disrupt HPO agency operations as well as remove the resource from other assigned work duties. In addition, a special service fee would be applied pursuant to N.J.S.A. 47:1A-5.c & 5.d, with a general estimated fee above $3,000.

My request for clarification of the records being sought was that such provided specificity towards the type of records you are interested in would enable the NJDEP to search and provide the corresponding records efficiency, thereby removing the agency disruption and special fee concerns.

The request for all emails and electronic communications does not provide the needed specificity. I will respond shortly to your other email.
