NJ League of Municipalities Records Involving OPRA (Open Public Records Act)

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Relevant Background & Opinions of Anonymous Requester
Irvington Township recently filed a rather disturbing lawsuit that shocked and upset a great number of New Jerseyans. It quickly became a big, statewide news story covered by many NJ news outlets.

The presumably frivolous lawsuit brought by Irvington (since abandoned) was brought against a female, African American, senior citizen OPRA requester that required the intervention of the American Civil Liberties Union (ACLU) to apparently "encourage" Irvington to dismiss the inappropriate lawsuit brought in apparent retaliation against this woman for exercising her right to free speech, her right to petition for a redress of grievances, and her rights under OPRA and common law.

Similar tactics appear to be a new and upcoming trend among New Jersey Municipalities to attack, belittle, defame, sue, threaten, and portray OPRA requesters as "problems" when they are simply exercising their very important, very lawful, and very much protected rights under New Jersey's Open Public Records Act.

In this regard, it was brought to my attention by an aide to a former New Jersey State Senator that the New Jersey League of Municipalities is a staunch opponent of the Open Public Records Act in its current form, and that the NJLM has been actively lobbying to have OPRA requesters CHARGED SUBSTANTIAL FEES for records responsive to their OPRA requests (currently there is rarely a fee for digital records) in an attempt to actively thwart public inquiries into government activities behind closed doors. OPRA, by contrast, is designed to shine a light on these hidden activities. Such government transparency needs to increase, not decrease, and definitely not be thwarted by politicians who fear the light of public inquiry into their often improper, inappropriate, wasteful, and/or illegal activities.

It appears that the NJLM may be involved in encouraging and advising various New Jersey municipal leaders in such a way that these leaders often feel far more inclined to attack, bully, harass, threaten, demean, intimidate, retaliate against, obstruct, dissuade, and otherwise undermine legitimate OPRA requesters in various ways -- often using very similar language.

The language of these increasingly common complaints made by municipal leaders against benign and well-meaning OPRA requesters appears eerily similar, as they often seem to use the same keywords and catch-phrases in their (often defamatory) attacks on OPRA requesters such as "voluminous requests," "unduly burdensome," and "harass, bully, and harm municipal employees," even when they are simple, ordinary, and infrequent requests.

In short, municipal leaders are actively dodging their responsibilities under OPRA and trying to blame requesters for their own failures and violations of OPRA, instead of simply responding to often very basic and straightforward OPRA requests in a timely, respectful, and professional manner -- and that needs to end.

As such, I am requesting records from the NJ League of Municipalities involving these increasingly-used keywords and catch-phrases as they relate to or involve OPRA requests and OPRA requesters.

One way to do this effectively would be to search for a individual "Keyword" in the list above plus the word "OPRA" such as:

It is unfortunate that your email signature includes the primary keywords I am searching for. This makes it prohibitively difficult (by design?) to locate OPRA-related records created by one of the premier organizations in the state that appears to be seeking to fundamentally change (undermine?) OPRA laws in the state. A coincidence? Perhaps. Perhaps not.

In any event, I would suggest removing OPRA-related words from your email signature files for all email records moving forward, or simply turn your OPRA-related signature into an image file that cannot be indexed and picked up in a keyword search for OPRA-related terms.

In the interest of public transparency, I would appreciate it if you could request any clarification you need via email rather than over the phone, and I will respond accordingly here (through OPRA Machine) as well.

Again, thank you for your efforts so far in attempting to fulfill my OPRA request, despite the perhaps ill-conceived signature file that you have been using.

Thank you for your response.

Please continue providing all responsive records via only email reply through OPRA Machine, as you have been doing thus far. Neither a CD/DVD nor uploading to a file-sharing service will suffice for my purposes.

One reason why so many people use OPRA Machine, besides automation, is because the attached records are promptly indexed by Google and other search engines, which helps increase public awareness of government activities through public records. This benefit alone is in substantial support of the purposes of OPRA, and this is, in large part, why my request is for records to be delivered via email back to the same opramachine.com email address.

The only way this automatic search engine indexing is possible is if you reply via email back to the OPRA Machine email address as requested with records attached. Thus, please continue providing records in the ongoing email attachment format, otherwise, it may certainly appear to be a thinly veiled attempt to hide these records from public view, and that would certainly run counter to the purposes of OPRA.

You can break the records up into smaller batches as needed by attaching several smaller PDFs to an email, and then make multiple submissions via several emails. It may take a little longer, but it's the only way to quickly make these public records available for all to review online and to have them search engine indexed.

As I believe it is primarily the League of Municipalities -- which supports various municipal governments who are often strongly averse to public records disclosure -- who is one of the primary opponents of government records disclosure in New Jersey, I feel it is imperative that all these public records become a part of the historic public record online.

Please do not zip or otherwise compress any of the files before attaching them to emails sent to OPRA Machine, as I do not know if OPRA machine will be able to unzip them. Simple PDF attachments will suffice, with the exception of course being records in other digital formats such as mp3, mp4, etc, which can also be attached like PDFs.

This email is in response to your request for records made April 20, 2022, where you have asked for documents related to the Open Public Records Act, more commonly referred to as OPRA. The League has previously identified and supplied you with responsive records but requested additional time to adequately complete your request as it pertains to emails.

In an attempt to identify records you have requested, I have performed a search of all League emails that contained the term “Open Public Records Act” in the subject line of the email and also contained within the body or any attachments of the email the individual 28 terms you have provided. This search was repeated using the term “OPRA” in the subject line of League emails.

Attached to this email are two Excel workbooks, the first titled “Subject - Open Public Records Act - Master Workbook” and the second titled “Subject - OPRA - Master Workbook.” These workbooks contain individual sheets corresponding to the related searches as described above. Column E in each of these sheets contains information related to the reason or reasons for any necessary redactions or if attachments were withheld. This is more commonly referred to as a “Vaughn Index” or privilege log.

The responsive emails have been converted to PDF files and any attachments, where applicable, can be opened from these PDFs in the attachment’s native file type. As previously anticipated the file size of these PDFs is too large to be sent via email. In order to facilitate the transfer of these responsive records to you the documents have been uploaded using the FileMail.com service, which allows the sharing of large documents free of charge and without the need to sign up for an account.

Thank you for your reply. Unfortunately, again, I had asked that you please provide the records in the format I requested:

I did not ask for "links to records" to be sent via email.

This "requested format" portion of my request was fully clarified and explained in detail in my last email to you.

By "email reply," I did not mean for you to reply with a "link" to a 5-day, self-destructing download, but to reply with the actual records themselves via email attachment.

The records need to be sent as an email reply with the records in PDF attachment format (.doc/.docx and .xls/.xlsx are fine for MS Word and MS Excel email attachments), just as you had been doing previously, otherwise the records cannot be properly hosted and displayed via the opramachine.com file-sharing server, which is the primary purpose of using opramachine.com in the first place -- so that public records can be made more readily accessible to the public at large.

Providing the records as proper, smaller PDF attachments would also mean that all the work you've put into compiling these records would be put to the greatest public use and benefit for many others outside of myself to review for years to come -- instead of only for me, and for just this one time, which seems like a colossal waste of time, energy, and money.

Once again, as I stated in my last email, a proper response in the format I requested may require that the NJLM send multiple email replies with smaller and/or fewer PDF attachments. This may take a little longer. However, I can be patient for them to be broken up into emails with smaller/fewer attachments on each, and emailed directly to the opramachine.com email address as non-compressed (non-zipped) PDF file attachments.

I believe you can probably submit up to 25MB of attachments per email, quite possibly even larger. You can send some PDF attachments to the opramachine.com email address to find out the file size limit (if there is one), as I'm not sure what oprachmachine.com's limit would be. If such emails bounce back to you undelivered because of file size, or won't send, they're obviously too large. Try a smaller file size. But I'd start with trying to send files in 100MB chunks and reducing from there as needed. That will likely save you time in the end.

Also, I believe the file sizes can likely be greatly reduced if they contain any duplicate emails causing the file size to be bloated. This would reduce the number of emails you would need to send to the opramachine.com email address.

Despite your long delays so far, I am willing to grant another OPRA extension to November 7, 2022 (one month) to allow you time to comply with my requested format.

Please be aware that the format you've provided the records in, and the alternative formats you offered to provide them in:
A) Do not suit the purposes of my request under OPRA and was not provided in the format requested, despite my clearly specifying such;
B) Repeatedly "timed out" my Internet connection when attempting to download the very large ZIP file (approximately 800MB);
C) Would severely limit public access to these records that have already been gathered by NJLM, by purposefully making the records inaccessible to the public, running contrary to the purposes of OPRA -- versus the way that the requested format (PDF email attachments) would greatly support OPRA's purposes;
D) Provides active links to the records only very briefly, which appears to be an attempt to shield these public records from public scrutiny, which again runs counter to the purposes of OPRA (NJLM set the links to expire a mere 5 days after delivery, so they'd already be defunct);
E) Would cost the OPRA requester money (via invoiced CD/DVD or a self-paid file-sharing service) that they should not have to pay for for digital copies of public records, and which would still not satisfy the purpose of the OPRA request, which is, in large part, to make such records available for ongoing public review;
F) Would likely compromise (deliberately?) a requester's right to anonymously request and receive public records under OPRA;
G) Appears to be a blatant refusal to provide the records in the requested format and an outright denial of a legitimate OPRA request;
H) Would largely be a waste of taxpayer money if tax monies were used to help provide these public records for only one person, versus for potentially thousands of people, in very strong support of the purposes of OPRA; and/or
I) While a requester might be able to download the zipped email records themselves from your server, for one to go through all the individual PDF email records in the zipped folder(s), and to click each individual email document attachment link in order to access and download all the separate attachments associated with each individual email, would be an unnecessarily onerous job that would likely also require more than 5 days to go through all the PDFs, locate all the email attachment links within the emails, and download all those attachments from your server individually before they are automatically deleted by the very short time-limit you set.
Instead, these email attachments should simply be provided as .doc/.docx, .xls/.xlsx, and .pdf files sent directly to the opramachine.com email address as attachments that would then be automatically, immediately, and indefinitely publicly hosted on the opramachine.com server, not as files hosted on your own server for only 5 days before being deliberately rendered permanently inaccessible to the public. It appears that several internal PDF links are already either broken or link to files on your server that no longer exist or are no longer accessible.

In light of the reasons stated above, and in light of your denial of my previous request for records to be sent via email as attachments that opramachine.com can publicly host on its free, file-sharing server(s), I believe this constitutes an improper denial of my rights under OPRA. I am going to consult with an OPRA attorney and other OPRA experts on how best to proceed.

In the meantime, I request that you reconsider your denial of my request and instead provide these public records as smaller files attached directly to emails sent to the opramachine.com email address as email replies to my request -- not as "self-destructing" links to very large (apparently bloated) zip files containing duplicate emails that are difficult to download, that are automatically deleted very shortly after you send them, that contain internal links to inaccessible email attachments, and that cannot be parsed by opramachine.com to be properly archived and search engine-indexed for ongoing public accessibility and searchability.

Your response only serves to underscore and exemplify my perspective that NJLM is very actively working to thwart and undermine the very purposes and foundation of OPRA in New Jersey, against the public will and benefit, and on behalf of corrupt public officials working in the various NJ municipalities who much prefer to operate under cloak of darkness and behind closed doors.

In light of my last email -- explaining very clearly the reasons and need for these public records to be provided as actual email attachments sent to the opramachine.com email address -- it seems you're essentially "flipping the bird" to the public at large, including to OPRA requesters such as myself. Unfortunately, I believe this attitude is entirely reflective of, and consistent with, how NJLM condescendingly views OPRA requests and requesters based on how NJLM may "verbally" declare its "support for public transparency," while at the same time actively working behind the scenes against such public transparency by undermining the effectiveness of OPRA by, as I view it, working steadfastly to reduce and limit the scope, accessibility, affordability, enforceability, and availability of public records under OPRA, instead of working to expand them.

In this age of extreme and ever-increasing government corruption -- in one of the most admittedly-corrupt states in the entire United States -- anyone working to limit and reduce the scope of OPRA is, in my opinion, on the side of helping to actively and deliberately shield and protect government corruption and corrupt government officials, instead of helping to shine a light on it/them in order to reduce public corruption, and are therefore a major part of the corruption problem itself.

As you've already put all this time into your long-delayed response, it seems, relatively speaking, to be a trivial matter to provide the records in the requested format -- as smaller email attachments that can be properly indexed and displayed for the public to review at opramachine.com moving forward.

Again, opramachine.com will host these records indefinitely as a free file-sharing service. However, it is up to the New Jersey League of Municipalities to provide those records in the requested format, as required under OPRA, such that they can be properly hosted by opramachine.com, which I have already discussed at length, clarified, and clearly requested.

You asked me to provide you with access to a file-sharing service to host the records. I already have. It's called opramachine.com, and it's 100% free. However, files need to be provided in the correct format (as email attachments) in order to be hosted.

I believe my request represents a prime example of why those who drafted the Open Public Records Act made it mandatory on the part of public bodies to provide records in the format requested wherever possible. And it is very much possible here. It's just being denied.

Please let me know if you have any further questions or require additional clarification. I will assume that outside of such a reply, or your providing the records in the format I have now repeatedly requested, that you have permanently denied my request for the records in the format I have requested and will proceed accordingly.

I am hopeful that you will reconsider your denial of my OPRA request and that you will accommodate my very reasonable, important, and relevant "format" request, which clearly advocates for public transparency in strong support of the purposes of OPRA.

Dear Frank Marshall,

Thank you for your and your staff's time invested in providing these public records, and for doing so in the format I requested, as well as for the professionalism you've shown in your communications. All this was greatly appreciated.

It is my hope that the NJLM will work with NJ State legislators to increase public transparency and access to government records, versus seeking to reduce or inhibit the scope of OPRA or to shift costs to requestors.

Ultimately, even if your primary concern is for the interests of the municipal representatives that your organization represents, it benefits NJLM to support, maintain, and even expand OPRA, as this helps ensure that municipal leaders are kept fully aware that the public is watching what they do behind closed doors. This, in turn, helps NJLM to have better, more upstanding clients and government representatives as a whole, as well as helps reduce various forms of fraud, waste, and abuse, which helps everyone who lives in the state.

Please consider taking a broader view on OPRA versus a more narrow view of simply trying to make NJLM's clients happier in the shorter-term by working to reduce the scope, effectiveness, and impact of OPRA, which appears to be NJLM's primary aim with regard to OPRA.

If NJLM works with state leaders to hobble, chip away at, and perhaps eventually cripple the effectiveness of OPRA, then the worst tendencies (i.e. wasteful spending, fraud, theft, abuse, etc.) of all our state's public representatives are much more likely to blossom unchecked, and we will only see more and more corruption in what is already arguably the most corrupt state in the union.

OPRA is one of the few accessible checks the public has on government, and it is therefore essential that it be actively protected, preserved, and enhanced - not progressively worn away at and dismantled in stages by organizations such as NJLM.

Please try thinking more broadly and holistically on the matter of OPRA. Consider how things link and tie together. The quality of NJLM's clients will degrade rapidly if the worst tendencies of public officials are permitted to run rampant due to the weakened checks of a deliberately undermined, weakened, and less accessible (financially and otherwise) OPRA.

OPRA not only acts as a government "disinfectant" by shining the "sunlight" of public awareness on government actions, but also acts as a deterrent to those who would seek public office to use government positions for selfish or greedy ends, versus from an attitude of humble and grateful service to the public. I think the latter are the types of clients you would much prefer having and working with long term.

We live in a very corrupt time that is only getting worse and, overall, the quality of our leadership has been steadily declining on both sides of the political aisle. If you undermine the check that OPRA provides on our leaders, which is analogous to the type of check a store security guard or a loss prevention specialist provides for a business, you will have done tremendous damage to the state and its residents that may never be repaired. Please guard and protect OPRA, even if out of self-interest, by thinking more broadly of the negative impact a degraded OPRA would have on everyone in the state.
