Good Morning: 

Please be advised that the County is processing your request to locate
documents responsive to your OPRA request. Your request requires
additional time beyond the seven (7) business days to process and locate
responsive documents. OPRA allows custodians to seek extensions of time
pursuant to N.J.S.A. 47:1A-5(i).  Specifically, OPRA states that, “the
requestor shall be advised by the custodian when the record can be made
available. If the record is not made available by that time, access shall
be deemed denied.”

Your request requires an extension of time until April 1, 2020.

Please be advised that the County has performed a search of the County’s
archives and has found no record indicating that minutes for the Planning
Board exist for 1977 or 1978. With regard to your request for
correspondence, please be advised that additional clarification is being
sought. Under N.J.S.A. 47:1A-1.1, et seq., requestors must identify
specific documents being sought and does not require records custodians to
interpret overly broad requests to search for "every document" or "all
documents.” See Bent v. Township of Stafford Police Dept., Custodian of
Records, 381 N.J. Super. 30, 37, 39 (App. Div. 2005). It is the
requestor's obligation to specifically describe the documents that are
being sought. The request may not be a broad, generic description of
documents as the custodian is not required to speculate about what the
requestor seeks, and is not required to survey agency employees regarding
the request. Bart v. Passaic County. Pub. Hous. Agency, 406 N.J. Super.
445, 451-52 (App. Div. 2009). Please provide additional information,
including the project’s block, lot, and municipality, so that the original
project file can be located.  

 

Please respond within seven (7) days including the additional information
requested, so that the County may process your request. Failure to provide
written clarification of your request will result in the closure of this
OPRA request.

Our request is now specific to the resolution R-107801 as passed by the New Brunswick City Council on October 4, 1978.

Please provide any documents relevant to this matter including but not limited to:
- Any request from the New Brunswick City Council for the Middlesex County Planning Board to review, approve, comment, or take any other action on this resolution
- Any correspondence or records of any correspondence received or sent by planning board members with respect to this matter or any matter relating to P.L. 1975, ch. 104 as referenced in R-107801 during the 4th quarter of 1978.
