Dear Mr. Makropoulos:

 

In connection with your OPRA request looking for “the identity of the
fingerprints found on the Make Edison Great Again racial flyers….and all
documents and evidence connection to the Committee of the Whole”, kindly
be advised as follows. 

 

First, in the criminal investigative context, fingerprint cards, mugshots
and similar materials are not disclosable under Governor’s Executive
Order.  The same privacy concerns apply here to prohibit disclosure in the
civil investigative context being undertaken by the Committee of the Whole
at this time.   Thus, the fingerprint results would not be publicly
disclosable.  With that said, however, special counsel to the Committee of
the Whole has advised that his office is not in possession of any
fingerprint results.

 

As to the component of your request seeking “documents and evidence”
pertaining to the Committee of the Whole in general, the bulk of the
Committee’s work includes non-public documents which are subject to the
investigatory and attorney-client privilege exceptions to OPRA
disclosure.  As a result, the bulk of the Committee’s records, which
pertain to the ongoing investigation, will not be produced.   Nonetheless,
in response to past records requests, the Committee has provided letters
and subpoenas sent by special counsel on behalf of the Committee to
witnesses.  Those documents would be disclosable if you have interest in
them.  If so, kindly let our office know.
