Dear Mr. Bailey:

 

With respect to that item of your recent OPRA request which is seeking all
major disciplinary internal affairs complaints from January 1, 2010
through December 31, 2019, please be advised that that aspect of your
request is denied.   The requested records are legally exempt from public
access.

 

First, Internal Affairs Complaints constitute “information generated . . .
in connection with any grievance filed by or against an individual” that
are exempt from the definition of a “government record.” See N.J.S.A.
47:1A1.1.   Moreover, the Township is legally precluded from releasing
Internal Affairs Complaints pursuant to the New Jersey Attorney General’s
guidelines. See N.J.S.A. 47:1A-9; Wares v. Twp. of West Milford, GRC
Complaint No. 2014-274 (May 2015) (concluding that the records custodian
properly denied access to the Complainant’s request for Internal Affairs
Complaints because such records are exempt from public access pursuant to
the Attorney General’s IAPP, which classifies these records as
confidential); Doe v. City of Trenton, 2019 WL 4927108 (App. Div. 2019)
(holding that since the requested documents were internal affairs
investigation records, they were confidential and exempt from disclosure
under the Attorney General's IAPP); Paff v. Bergen Cty., 2017 WL 957735
(App Div. 2017) (ruling that the Attorney General’s Guidelines
unequivocally require internal affairs investigation reports to remain
confidential).  Accordingly, the Township is denying access to the
requested materials.
