DOH-DHEPRCUSTODIAN, NJ Department of Health Division of Public Health Infrastructure, Laboratories and Emergency Preparedness

Dear Requestor:

This will respond to the above referenced request for
government records on behalf of the Division of Public Health
Infrastructure, Laboratories and Emergency Preparedness

.  Your request is a request for information, is vague and/or broad, and
does not request an identifiable government record.  Your request would
require the Department to conduct research through all of the Department’s
records and/or to create a record in order to respond to your request,
and, as such, the request is improper and I am required by law to deny
your request.  See Bent v. Twp. of Stafford Police Dept., 381 N.J. Super.
30 (App. Div. 2005); and MAG Entertainment v. Div. of Alcoholic Bev.
Control, 375 N.J. Super. 534 (App. Div. 2005).

Because your request for access to a government record has
been denied, you have a right to challenge the decision by the Department
to deny access.  At your option, you may either institute a proceeding in
the Superior Court of New Jersey or file a complaint with the Government
Records Council (“GRC”) by completing the Denial of Access Complaint
Form.  You may contact the GRC by toll-free telephone at 866-850-0511, by
mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at
[email address], or at their web site at www.state.nj.us/grc. The
Council can also answer other questions about the law.  All questions
regarding complaints filed in Superior Court should be directed to the
Court Clerk in your County.

If you have any questions concerning this communication,
please call me at 609-633-7777

Sincerely,

Thomas A. Starr, MICP
