Dear Connell, Maureen,

Hello Maureen,

I made the request on January 31st. I should received a response on February 11th. I now have one 2 days later. The OPRA law says below the only delay should be because the records are in use or storage. Can you provide a reason why I received a response after the required 7 days by law. It also states that you the custodian can make a request to me in writing, does not say that you can just tell me you need an extension. So now I am waiting a total of 19 days, for records you can't provide within 7 days. Can you please provide me a reason. I am in need of these records ASAP.

Custodians may seek extensions of time beyond the seven (7) business day deadline forlegitimate reasons (e.g. the record is in use or in storage). N.J.S.A. 47:1A-5.i. Custodians must request an extension from the requestor in writing, within the statutorily mandated seven (7)business days and provide an anticipated deadline date upon which the records will be provided.The length of the extension must be reasonable. Failure to grant or deny access by the extendeddeadline date results in a deemed denial of the request.

Dear Mr. DePasquale,

In response to your February 13, 2020 email which I received this morning, be advised that I was at a seminar the afternoon of January 31st (which was a Friday), and therefore didn’t receive and log your OPRA request until Monday, February 3rd. Measuring from February 3rd, the initial response date was February 13th, which was yesterday.

However, the Township Health Department – which maintains these records – needs time to redact private information before the list of seniors may be produced to you pursuant to your request. Disclosure of the home addresses of those individuals cannot be provided, since home address information impinges upon personal privacy. It is for that reason that the extension request was made to you on the 13th by our office (again the due date measuring from Feb. 3rd, for the reasons indicated above).

As indicated in my extension request email, we will certainly provide the records if redacted and available sooner.
