1) Job Description Posting (which shall include job posting itself and any documentation of posting online or in newspapers) for FULL TIME PUBLIC WORKS LABORER LEVEL 1 that was filled by the Borough Council via RESOLUTION NO. 2021-128

2) All applications for FULL TIME PUBLIC WORKS LABORER LEVEL 1 that was filled by the Borough Council via RESOLUTION NO. 2021-128. This shall include any and all adjoining attachments (of course redacted to exclude certain personal information as required by NJ OPRA statute)

3) Job Description Posting the for Borough Clerk position (which shall include job posting itself and any documentation of posting online or in newspapers) that that was filled by the Borough Council via RESOLUTION NO. 2022-001 (or any other resolution at said meeting) during the 1/3/22 Borough Council Meeting

4) All applications for Borough Clerk position that that was filled by the Borough Council via RESOLUTION NO. 2022-001 (or any other resolution at said meeting) during the 1/3/22 Borough Council Meeting (of course redacted to exclude certain personal information as required by NJ OPRA statute).

The Borough of Englishtown received your Open Public Records Act (OPRA)
request on January 11, 2022.  As such, the seven (7) business day deadline
to respond to your request is January 21, 2021.  This response to your
request is being provided to you on the 3rd business day after the
custodian’s receipt of said request.
Your request sought access to the following:
"1) Job Description Posting (which shall include job posting itself and
any documentation of posting online or in newspapers) for FULL TIME PUBLIC
WORKS LABORER LEVEL 1 that was filled by the Borough Council via
RESOLUTION NO. 2021-128" 
Please see the attached Newspaper Media Group invoice and wording of ads
placed.
 "2) All applications  for FULL TIME PUBLIC WORKS LABORER LEVEL 1 that was
filled by the Borough Council via RESOLUTION NO. 2021-128. This shall

Per Executive Order No. 26 (McGreevey 2002), the resumes of unsuccessful
candidates are to be disclosed only where the unsuccessful candidate has
consented to such disclosure.   The Borough of Englishtown has not
received such consent, therefore these records are exempt from
disclosure.

No records exist with respect to newspaper or online postings.  Please see
job description attached. 

 "4) All applications for Borough Clerk position that that was filled by
the Borough Council via RESOLUTION NO. 2022-001 (or any other resolution
at said meeting) during the 1/3/22 Borough Council Meeting (of course
redacted to exclude certain personal information as required by NJ OPRA
statute)."

Per Executive Order No. 26 (McGreevey 2002), the resumes of unsuccessful
candidates are to be disclosed only where the unsuccessful candidate has
consented to such disclosure.   The Borough of Englishtown has not
received such consent, therefore these records are exempt from
disclosure. 

If your request for access to a government record has been denied or

right to challenge the decision by the Borough of Englishtown to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.

Regarding Points #2 and #4, with your position regarding EO#26 (McGreevey, 2002) excluding the applications and resumes of unsuccessful candidates, your position DOES NOT prevent the release of information of the individuals who were successfully hired as the FULL TIME PUBLIC WORKS LABORER LEVEL 1 and BOROUGH CLERK positions.
