Dear Long Branch City,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

1 The list of blocked people associated with the original administration account created to create the police Facebook page.
The list called Block users.
2The list of blocked or banned people on the police Facebook page.
3 The list of blocked words for the police Facebook page.
4The social media police policy for censorship of speech on the police Facebook page. The policy describing the procedure for placing people on the administrative block user list and the banned people list.
5 the written employee policy describing the duty requirements to obey the nj open public records law. The employee policy describing the discipline or punishment for not providing records as per the law and policy.
I want our records as they are now. Other municipalities have tampered with public records by first clearing the names off the list then sending a empty list. The evidence of this is easy to show. People in these lists have screen shots showing clearly they are on them. People on the longbranch police banned or blocked list only have the option to share. They can not comment. Screen shots show this. I hope they do not choose to tamper with records. Proof of that will be easy to prove.

These records can be accessed from any computer with a internet connection all that is required is the administrator account information. I can get these records from my own home. They have maintained this page for some time. They should be well versed in its use.
The public has a clear interest in knowing who is being denied the right to speak on a tax maintained forum open to the public and advertised to the public. A social media account whose nature of use is and shows is a back and forth conversation between the public and the public servants who created the page.
The public has a clear interest in knowing who is being censored by Government. Why government is doing it. If the government has the lawful authority to do it.

Attached please find information you requested through OPRA from the City
of Long Branch:

 

1.        There is no “administrative account created to create the PD
Facebook page.  It was created by the employees page. 

2.       A screenshot of blocked/banned people/pages from the PD Facebook
page is attached.

3.       A screenshot showing profanity filter is set to “strong” and
showing no additional words being blocked is attached.

4.       The only thing that exists in regards to #4 request is the policy
that is posted on Facebook.  It is attached as screenshots.

5.       There is no written policy.

Dear Kathy Schmelz,

Thank for the records sent. So to clarify no written policy compelling the police employees to obey nj records law exists. That if employees violate records law no internal affairs complaint can be made as no policy exists.
To clarify you are telling me no policy is in place describing a employees responsibility to honor and produce records requests. Other municipalities and police departments have a policy. It's very concerning that long branch does not want transparency in its law enforcement considering recent events.
