We are requesting documents relating to the Property relative to the presence of and/or environmental records and permits pertaining to underground storage tanks (USTs), aboveground storage tanks (ASTs), discharges, spills, leaks, hazardous materials, landfilling, air/water/soil contamination, and/or investigation and remediation of environmental areas of concern, Classification Exception Areas (CEAs), Deed Notices, ECRA/ISRA filings, No Further Actions, any enforcement actions, or any other relevant information at the following property:

233-235 Main Street (Block 39, Lot 2.01 - "Main Street Village Shopping Center") in Matawan, NJ.

Good afternoon,

We are in receipt of the attached Request, which has been forwarded to the
appropriate Department(s).  Upon review of the attached, I have
respectfully modified a portion of your request to a Listing of
Construction Department Applications,  which will reflect a list of
Construction permits applied for, as well as if they are open/closed. 
This may help determine if there was a storage tank ever removed from the
property location.

 

A precursory search of our files has not produced any documents responsive
to the remaining portion of your request.  However we will reach out to
other Borough departments on your behalf, requesting that they search
their records for those items and to provide any copies, if they are
available.  Your request for any other relevant information has been
deemed complex.

 

You may find some of the information you seek by going onto the State’s
DEP Known Contaminated Sites website, which can be found here: [1]NJ DEP
KCS.  Deed information for properties located within the Borough may be
found on the County’s website, which can be found here: [2]MC OPRS.  Hope
these sites help your search.

 

If I have misinterpreted your Request, please notify me immediately. 
Otherwise we will proceed accordingly and the Ready Date will be on June
13, 2022.

 

FYI: When a Request seeks information or asks questions and does not
identify specific government records, it is deemed “complex”.  When a
request is “complex” because it fails to specifically identify the
documents sought, then that request is not “encompassed” by OPRA. See New
Jersey Builders Association v. New Jersey Council on Affordable Housing,
390 N.J.Super. 166, 180 (App. Div. 2007).  A proper request under OPRA
must identify with reasonable clarity those documents that are desired,
and a party cannot satisfy this requirement by simply requesting all of an
agency's documents.  See Bent v. Stafford Police Department, 381
N.J.Super. 30, 37 (App. Div.  2005).

 

Custodians are not required to conduct research or create new records in
response to an OPRA request.

As we await a reply from one additional Department, we will require
additional time beyond the seven (7) business days to fulfill.  OPRA
allows custodians to seek extensions of time pursuant to N.J.S.A.
47:1A-5.i. 

 

We respectfully request a week’s extension to on or before June 20, 2022.

 

In the interim, as yellow highlighted below, we attach a List of
Construction Department Applications.  We also inform the Borough has no
“No Further Action” letters on file.
