Your request will need the assistant of our IT specialist. The Borough changed IT specialists on January 1, 2019. The two companies are transitioning and therefore your request will require a 7-day extension to January 31, 2019 to rerspond to.

Good afternoon,

Preliminarily, our IT specialist has indicated that it would require up to three hours of programs and related work to fulfill your request. I am working to get more details regarding this and will provide those detail to you once I have them.
Specifically, [N.J.S.A. 47:1A-5(d)] allows for a service-fee charge when the request for a record requires a substantial amount of manipulation or programming of information technology.
Our IT Specialist estimates the cost of this request to be $406. That cots would have to be paid by you, before any records are provided.
As I stated earlier, I will be providing additional details regarding this cost and possibly additional costs to review the logs and redact any information that is determined to be exempt from public disclosure under OPRA.
I am informing you of this today to give you the opportunity, if you so choose to take it, to modify your request to reduce its scope and therefore reduce the costs to you.
Please advise if you wish to modify your request or if you wish to proceed with the request as submitted.
You can modify your request after the final estimate of costs is provided, however, the revised request will also need to be evaluated and a revised cost estimate will need to be provided which could delay the delivery of the records.

I have received an e-mail regarding this OPRA requests. In my opinion, the agency has a right to oppose special service fees because the request is a voluminous request. The OPRA request needs to be broken up into smaller ones with shorter time frames in order to make it easier for the agency. I had a similar issue with an OPRA request that I filed with the Middlesex County Prosecutor's Office.

The number of requests from South River made by this same individual over such a short period of time is crazy. Frankly, I’m surprised they haven’t attempted to impose charges or fees sooner. I’m sure they have expended quite a high number of man hours between borough staff and police department staff over what is clearly a political vendetta here. My advice: stop abusing these OPRA requests and subpoena the records through your attorney.
