Our apologies for the delay.  However, please be advised that we cannot
fulfill your request for records.  Your request for the "disposition" as
"substantiated, unsubstantiated, etc.." does not reference a record in
existence.  OPRA only countenances requests for identifiable records, not
requests for information.  See MAG Entm't, LLC v. Div. of Alcoholic
Beverage Control, 375 N.J. Super. 534, 549 (App. Div. 2005). 

 

In addition, even if such a record existed, it would pertain to an
internal affairs investigation, a subject matter which our courts have
ruled to be exempt from disclosure under OPRA.   Paff v. Bergen Cty.,
A-1839-14T1, 2017 WL 957735, at *5 (N.J. Super. Ct. App. Div. Mar. 13,
2017)(“The nature and source of internal allegations, the progress of
internal affairs investigations, and the resulting materials are
confidential information.”).  Therefore, we cannot fulfill your request.
