Good Day,

I have created a request using our new OPRA request system that can be
found on our website.  Attached is a letter with a reference number for
you.  The TRPD records department does not process the dispositions of
cases or complaints.  That is a matter for the Toms River Municipal
Court.  You should direct your request to them.

Dear Seaman, Sam,

My request was directed to the Township Clerk is the Custodian of Records for the Township of Toms River. The Clerk forwarded it to you to be fulfilled. If you can not fulfill my request then please advise the Custpdian of Records to direct it to the proper person.

Yours sincerely,

J Alexander

Dear Toms River Township,

Please pass this on to the person who conducts Open Public Records Act reviews.

I am writing to request an internal review of Toms River Township's handling of my OPRA request 'Disposition of Complaint’

It has past the 7 working days set forth under OPRA to respond to my request. Therefore I am requesting an internal review as to the delay and requesting a prompt response to my original request.

A full history of my OPRA request and all correspondence is available on the Internet at this address: https://opramachine.com/request/disposit...

Yours faithfully,

J Alexander

J Alexander,

The Reply from our Township Attorney:

If the requestor is seeking municipal court records, they have to request
them from the municipal court as provided under Court Rule 1:38.  The
municipal court is an arm of the judiciary and is governed by those rules.

Subject: OPRA Request

Hello J Alexander,

An timely email was sent to you back to your email address by Mr. Sam
Seaman explaining the PD does not provide (or even house) Municipal Court
records.

We received your request here in the Clerk’s Office, but criminal records,
I believe, and will confirm, are excluded from OPRA.

I am copying in the Township Attorney Ken Fitzsimmons to opine if your
request of the disposition and/or status of the criminal complaint signed
by the TR Police Dept. against Justin T. Lamb in May 2018 for simple
assault is, in fact, disclosable under OPRA rules.

Thank you,

Alison L. Carlisle, RMC
