Dear Mr. Kratovil,

Please accept this letter as the University Custodian of Records response
to your request for records pursuant to the Open Public Records Act
(“OPRA”). On April 30, 2019, this office received your request for the
following:

“Under OPRA and the common law right of access, please provide complete,
certified election results (broken down unit-by-unit) for each Daily
Targum referendum for the following years: 2013, 2016, and 2019.”

The University has reviewed your request and determined that the records
requested are not "government records" under the definition of OPRA.
N.J.S.A. 47:1A-1, et seq. The records you have requested are made and
maintained entirely by a student organization and are not University
records. Therefore, your request is denied.

If your request has been denied, you may take your appeal to the New
Jersey Government Records Council (NJGRC), which has mediation and dispute
resolution procedures, or you may file a lawsuit with the New Jersey
Superior Court, as provided by N.J.S.A. 47:1A-1, et seq. Your rights of
appeal is provided with this letter at [1]Public Facing Pages of the
Rutgers University Open Public Records Request Center. You may also review

Dear Rutgers Open Public Records Center,

Please take notice of University Policy 10.3.3, which applies to the referenda in question here. Section XIII.E.1 of that policy reads as follows: "Results of the referendum shall be released to the public and campus news media following tabulation and certification of the results by the Oversight Committee and official notice of the results shall be sent to the President of the University, the Vice President for Student Affairs, and the Executive Secretary of the University Senate."

Are you stating that the President of the University, the Vice President for Student Affairs, and the Executive Secretary of the University have all failed to maintain the records in question? Or are you stating that they were never transmitted to those entities, as is required by the University's policy? Please confirm if any of these entities have the requested information and, if so, provide it promptly. Thank you for your help.

Yours sincerely,

Charlie Kratovil
