Dear Stephen Sayer,

Thank you. I am happy to grant that extension.

Yours sincerely,

Dear Stephen Sayer,

As a further follow-up, after closer examination of the communications you sent me, I noted that there is no correspondence between Michael Testa and members of the CCPO in 2016 or 2017 that was provided (with the exception of one letter which was included as an attachment from a September 28, 2018 email). As correspondence from this period unquestionably exists, please can it be provided to me also.

Additionally, please can the following be provided, which were refered to (but not included) in the previous batch of communications:
Letter/email dated August 8, 2016 from Harold B Shapiro to Michael Testa (including any and all attachments)
Letter/email dated September 25, 2018 from Michael Testa to Harold B Shapiro (including any and all attachments)
Investigation Report attached to March 19, 2018 letter from Harold Shapiro to Michael Testa
Letter October 5, 2018 from Harold B Shapiro to Michael Testa regarding plea offer.

Yours sincerely,

Yours sincerely,

Dear Stephen Sayer,

Two quick follow-ups regarding two letters that were not denied but also not provided:

- Letter/email dated September 25, 2018 from Michael Testa to Harold B Shapiro (including any and all attachments)
This was not found in your search, but may have been sent as an email on 9/26/2018 or 9/27/2018. For your reference, this letter is referred to in Holly Moore’s 10/5/2018 email to Michael Testa, and the attached letter of the same date from Harold B. Shapiro to Michael Testa.

- Letter October 5, 2018 from Harold B Shapiro to Michael Testa regarding plea offer.
This should have been numbered as (19) but I believed was overlooked accidentally. For your reference, this letter is referred to in the November 8, 2018 letter from Harold B. Shapiro to Michael Testa.
[N.B. Another 10/5/2018 letter/email from Shapiro to Testa has already been provided, but it is not regarding this subject matter.]

If these can be delivered, that would conclude the business of this specific request.

Yours sincerely,
T.K.

With regard to the two records referred to below:

With regard to a letter/email dated September 25, 2020 identifiable via an electronic search of this Office's email records, this office has no responsive records. Our records indicate that no such communication was made and stored within our electronic records on either September 25, 2018, September 26, 2018, or September 27, 2018.

With regard to a letter dated October 5, 2018 matching your described parameters and identifiable via an electronic search of this Office's records, there appears to be no responsive record matching the content parameters you have described - however, it should be noted once again that there was one record (previously provided, reattached to this email as Responsive Record A) which did match your requested parameters of occurring in the stated time period, between the stated recipients, and utilizing the search term "Jeffrey Profitt". No other communication dated October 5, 2018 was identified within those records.

Dear Stephen Sayer,

I am writing to appeal the refusal of my records request, which you sent to me yesterday. I was not asking for the creation of a new record, merely a series of screenshots or printouts from CCPO's email system showing the responsive emails to the two search terms I requested. If these can be provided, I will be able quickly and efficiently request only the emails which a) are relevant to my research parameters and b) have not been already provided to me by your Office. The alternative would be a lengthy process in which I request all these emails, piecemeal, over numerous requests, which would be both lengthy and work-intensive for both parties. Furthermore, other entities have previously provided lists of responsive emails to me in response to similar OPRA requests, therefore I believe such a request is covered by OPRA law and permissable, not to mention quick to execute.

Yours sincerely,
T.K.

Stephen Sayer, Cumberland County

Mr. Karan,

In the interest of transparency, please allow me additional time to confer with our IT department to see if there is any conceivable way to generate a list of the information you are requesting. I will get back in touch with you as soon as possible once I have learned what is possible with regard to obtaining this electronically stored information and converting it into a document that could be provided to you.

Mr. Karan,

I apologize for the confusion with regard to this issue - I have been informed that IT has the technological ability to provide a list of responsive email records to your specified parameters. For the sake of clarity, your search parameters were specified in this case as:

(2) All emails sent to or received by email addresses ending in "@co.cumberland.nj.us" utilizing the search term "17-02-118-I" occurring between June 1, 2016 to December 31, 2018.

(3) All emails sent to or received by email addresses ending in "@co.cumberland.nj.us" utilizing the search term "18-10-943-I/B" occurring between June 1, 2018 to October 31, 2020.

As originally requested in your OPRA request dated October 30, 2020, and referenced in your OPRA request dated November 23, 2020 for a list of the responsive records to those requests as stated above. I have been provided with the attached excel spreadsheets by my Office and instructed that they contain the results of those searches conducted of our electronic records. While I was originally instructed that the responsive records in this matter amounted to roughly seven hundred, I have been informed that the attached spreadsheets accurately reflect the total number of responsive emails matching the above search parameters. The voluminous amount of results is likely due to the search term being a string of numbers, and would likely be narrowed significantly with the usage of narrowing search terms, a smaller time window, or limiting the search window to specific individual email address recipients.

To further clarify, this email does not refer to your below OPRA request originally referred to in this email chain, which is your request posed on December 2, 2020. You can still expect to receive a response from this Office along with all responsive records to that request on or before December 11, 2020.

- Stephen C. Sayer

show quoted sections

Dear Stephen Sayer,

Thank you for these documents, and for your clarification regarding the other component of my request.

I understand that the CCPO email system search function does not seem to be able to zero in on that string of numbers and letters, which is unfortunate. My request for those terms to be searched specifically is that the defendant's name was spelled one way initially, and then corrected about two years later, meaning a comprehensive set of responsive documenents was complicated to assemble. I had hoped that using the two indictment numbers would simplify that process.

Based on what you sent me, the emails I would request be sent, with any and all attachments, are as follows:
1/31/2018 8:19 Andre Araujo <[email address]> Danielle Pennino <[email address]> Profitt docs (break in case of Harold)
9/24/2018 9:45 "Loteck, Anthony" <[email address]> Ronald Cuff <[email address]> FW: Use of force breakdown by year and officer 2016-2016
