Dear Karen Stallings,

In regards to my request for inspection records and reports that were personally conducted by Ken Anderson you cite a case referencing using OPRA as a search engine. I would point out to you that inspection reports signed and completed by Ken Anderson are documents that should be readily available and stored by the Township as official records as required by law. I reviewed similar requests to Berkeley Township for reports and records that have been completed by various departments in which the Township fulfilled and complied to the OPRA request. Can you please explain why this request is different since the case you cited does not reflect your reasoning for not providing the documentation that should be completed by Ken Anderson if any inspections were in fact personally conducted by him? Your action is inconsistent with previous OPRA requests to Berkeley Township that have been fulfilled.

The Township does not have the capability to run a computer generated report with only one person's inspections. The Inspections are in the computer by PROPERTY ADDRESS ONLY . In order for the Township to comply with this request the Department's secretary will have to pull every single paper inspection to see who signed off on the inspection and pull out the ones Ken Anderson did. Once this is done those inspections will have to be scanned and the request was four(4) years of inspections. This request is voluminous, and the requested documents are located in storage. I would estimate approximately 4000 file folders containing 5 to 50 separate pieces letter and legal paper. Complying with this request would require an extraordinary expenditure of time and resources and pursuant to NJSA 47:1A-5(c) I estimate it will take approximately 40 hours to retrieve, review, and scan each file and/or any single specific document located within same. As such below is an estimated cost to produce this request and the time frame to complete same is 30 days from receipt of deposit.
$23.00 per hour x 45 hours = $1035.00. A Deposit of $517.50 is required BEFORE the Township will begin the work. Please keep in mind there is only one person covering the office so the Township may have to request additional time to complete the request and additional costs.
