Dear Buena Borough Fire District #2,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

Following closed session at your September 27, 2022 Commissioner meeting, two resolutions were approved in which I am requesting clarification.

1. According to Title 40, only a municipality has the authority to create or dissolve a fire district. I am requesting clarification as to why or who advised Commissioners of Fire District #2 to approve a resolution to spend taxpayer money to fund a consultant to do a study on whether Buena Borough should have one or two fire districts. This is an expense that should be incurred by the municipality of Borough of Buena, not a fire district, as that is who would have a direct interest in this subject.

2. A resolution was approved to consolidate bank accounts. Please indicate which bank accounts Commissioners of Fire District #2 intend to consolidate and whether any of the accounts being consolidated contain the funds District #2 obtained as a result of Buena Borough Ordinance 701, the dissolution of District #1, as either the funds from the bank account or sale of assets (firetrucks & equipment) from District #1.

There was only one resolution read at the meeting on the 27th, and that was to enter into Closed Session to discuss pending litigation. The two subjects you are referring to were motions that were made, and approved. In regards to your first question, the actual language that was used was "station", not district.

In regards to your second question, a motion was made to consult with our auditor, Bill Martini about consolidating accounts. No decision was made on consolidating any accounts at this time.

Dear Minotola Fire Commissioners,

Regarding my second inquiry, the exact statement made at the 9/27/2022 commissioner meeting was "...motion for consolidation of bank accounts under the direction of Bill Martini." Was that a misstatement? If so, it should be corrected at your next commissioner meeting.
