I am writing to request an internal review of Elizabeth City's handling of my OPRA request 'Bodycam footage from MVA on or about 06/08/19'.
I made the above request on July 15, 2020. Since then, I have received numerous notifications that "more time is needed" to fulfill my request.
It has been six weeks since my original request.
A response to this request is grossly overdue, even in light of COVID-19.
This request was made in conjunction with active litigation. In consideration thereof, the requested bodycam footage is relevant to our client's defense and is necessary in order to continue the progress of this case.
Please look into the delay of the response to this request, as it becomes more urgent with passing time.

additional seven (7) day extension for all reports as time is needed to
redact certain personal identifiable information. There are no photographs

identifiable information omitted. See Burnett v. County of Bergen, 198
N.J. 408 (2009). 

 

We are still in the process of reviewing all Body Worn Recording (BWR) and
request an additional seven (7) day extension for your request. However,
once reviewed and determined to be released, they will be provided to you
via DVD disc. Therefore, please provide our office with a physical address
to forward these records.
