Please note, pursuant to the Family Educational Rights and Privacy Act
(FERPA) student employees are not included on this report. 20 U.S.C. §
1232g; 34 CFR Part 99. Student employment is often tied to financial aid
or other funding sources and therefore student employment records are
exempt from disclosure under OPRA. N.J.S.A. 47:1A-9.
Reqeusts 3)-5) are denied as the requested information is personnel
information which is exempt from disclosure. OPRA specifically exempts
personnel records from public access with limited exceptions including an
"individual’s name, title, position, salary, payroll record, length of
service, date of separation and the reason for such separation, and the
amount and type of any pension received. N.J.S.A. 47:1A-10. OPRA, as it
relates to personnel records, begins with a presumption of non-disclosure
and proceeds with a few narrow exceptions that would need to be
considered. Kovalcik v. Somerset County Prosecutor’s Office, 206 NJ 581 at
594 (2011).
Request 7) we are unable to fulfill on the basis that we are unable to run
a report with such detail on the scale of the entire University. If you
wish to review any individual's pay breakdown, we can provide that
information on a more individualized basis.
If your request has been denied, you may take your appeal to the New
Jersey Government Records Council (NJGRC), which has mediation and dispute
resolution procedures, or you may file a lawsuit with the New Jersey
Superior Court, as provided by N.J.S.A. 47:1A-1, et seq. Your rights of
