Dear Monmouth County,

This is a request for public records made under OPRA and the common law right of access. I certify under penalty of perjury that I have not been convicted of a crime anywhere in the United States.

This request is in regards to the primary held on June 5th 2018,
for all election districts and/or wards in the county,
for all candidates for Democratic county committee,
both male and female,
both those on the ballot and write-ins.

For each of these candidates, please provide:

1. Municipality name,
2. Election district and/or ward,
3. Candidate name,
4. vote count, and
5. an indication of whether the candidate was a write-in or listed on the ballot.

Please provide this information in its original electronic format.

If the original electronic format does not allow its text to be easily selected and manipulated, then please provide it in a secondary format that satisfies this condition. An example alternate format is a tab-delimited text file, or spreadsheet, where each of the above five items are in its own column, with one candidate per line.

Please be advised this office represents the County of Monmouth (“County”)
as Special County Counsel in regards to your OPRA request submitted on
June 16, 2018 and received on June 18, 2018.

 

For ease of reference, your OPRA request seeks the following:

 

This request is in regards to the primary held on June 5th 2018, for all
election districts and/or wards in the county, for all candidates for
Democratic county committee, both male and female, both those on the
ballot and write ins.

For each of these candidates, please provide:

 

1. Municipality name,

2. Election district and/or ward,

3. Candidate name,

4. vote count, and

5. an indication of whether the candidate was a write-in or listed on the
ballot.

 

As a threshold matter, please be advised that your request is invalid
because it fails to identify with reasonable clarity the specific
government records sought and constitutes a “blanket request” for a
various class of documents.  See Murphy v. N.J. Dept. of Corrections, GRC
Complaint No. 2015-340; Bent v. Stafford Police Department, 381 N.J.
Super. 30, 37 (App. Div. 2005) (noting that OPRA allows requests for
specific records, not requests for general information, data or
statistics). The request may not be a description of information that
requires the custodian to search the agency’s files and “analyze, compile
and collate” the requested information. Id. See also MAG Entm’t, LLC v.
Div. of Alcoholic Beverage Control, 375 N.J. Super. 534, 549 (App. Div.
2005). MAG Entertainment, LLC held, “[w]hile OPRA provides an alternative
means of access to government documents not otherwise exempted from its
reach, it is not intended as a research tool [requesters] may use to force
government officials to identify and siphon useful information.”  Id. at
547.  “Under OPRA, agencies are required to disclose only ‘identifiable’
government records not otherwise exempt.”  Id. at 549; see also Burke v.
Brandes, 429 N.J. Super. 169, 174 (App. Div. 2012) (citation omitted);
Lagerkvist v. Office of Governor of State, 443 N.J. Super. 230, 237 (App.
Div. 2015) (holding that OPRA does not convert a custodian into a
researcher, which would have been the effect of the request).  Notably, it
is well settled that a “blanket request” for a various class of documents
rather than a request for specifically identifiable records is invalid. 
See Abdur-Raheem v. N.J. Div. of Criminal Justice, GRC Complaint No.
2014-171 (June 30, 2015).

 

Please submit a revised OPRA request that identifies the specific
government records you seek within the next seven (7) business day. In the
event you fail to provide a revised OPRA request, the County will deem
this request answered and closed. Thank you for your prompt attention to
this matter.
