I am writing to request an internal review of Stockton University's handling of my OPRA request 'All communication between Stockton University employees and NJDEP regarding the research project on 753 Walnut St. and it's connection to MLK Jr..'.

I originally filed my request on November 30th of 2017, with a response expected within 7 days. When the day came to receive the information nothing was ever sent, so the next day I sent an email asking about the status of the request. I then get a letter requesting an extension for another 7 days to the 20th of December, which I think is unreasonable. I can go into my emails and print out a list of all communications I have had with certain individuals within a couple of hours, why can't you? This information if not archived or stored away in a warehouse, it's right there on the computer. This request for an extension of time only give time for collusion, deletion and recreation or communications. The purpose of the 7 day response period is to not allow for such transgressions. Please provide the requested information to me today or a complaint will be filed with the state.

Please understand that we will provide the documents that you requested on
November 30, 2017. Your current open OPRA request (#113017-3) sought
access to the following:

·         "All communication between Stockton University employees and the
NJDEP regarding the research project on 753 Walnut St. and its connection
to MLK Jr, such as emails, letters, faxes and requests made of the
research team by any and all NJDEP officials. I am also seeking all
interpersonal communications by Stockton employees regarding the study,

This request requires the review of a large volume of documents in order
to insure that the response provides specifically the documents requested
in accordance with the Open Public Records Act. Ms. Frazier advised you on
December 11, 2017 that the review will require additional time and the
revised delivery date will be December 20, 2017.  You responded to Ms.
Frazier’s notice of extension on November 11, 2017.  Attached please find:

 

1.  Mr. Duff's email canceling his first OPRA request, and confirming
continuation of the second request (#113017-3)

 

2.  SU email dated 12-1-17 acknowledging OPRA request. The acknowledgement
email as a "reply" to Mr. Duff's email mentioned in #1, above. 
Unfortunately, the email address corresponded to the cancelled OPRA
request.

 

3.  SU email dated 12-11-17 extending OPRA response deadline. This email
was subsequently sent to the cancelled OPRA email address which auto
populated the "To" address line.

 

4.  Mr. Duff's email dated 12-11-17 responding to the extension notice.

 

I will provide the responsive documents as timely as possible.  Thanks you

The amount of redaction in these email is not legal. There is no way that entire emails are protected. I will be filing a complaint with the state if you fail to comply. You might as well have not sent anything rather than pay some poor lawyer to sift through these and try and figure out how much he could redact by divided legal arguments. This is why OPRA was created, so we can see when you are hiding stuff.

How can communications from 8-20-2016-10-31-2016, the months before an RFP was ever created by the NJDEP, be privileged communications? Also, why are all of the communications from Sharron Musher redacted? Is she not an employee of Stockton? Please send me these documents unreacted or I will be forced to file a complaint.

Stockton has provided you with copies of all requested documents with redactions to records exempted from disclosure under N.J.S.A. 47:1A-1.1. As relevant here, we provided redacted copies subject to the following exemptions:
• Inter-agency or intra-agency advisory, consultative or deliberative material.
• Certain records of higher education institutions: Research records

The custodian of records redacted several emails that I argue should not be redacted, so a complaint has been filed with the GRC. I wanted to test to see how the GRC works compared to conventional courts since I already have a suit filed against the City of Camden for not having minutes to their meetings.
