All building application approvals and any violations for 55 Chestnut Street. Also, any legal action being taken against this property..

The request was successful.

Dear Rochelle Park Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested: I am still awaiting from the Building Dept. the violations issued, and the action to be taken on this blatant disregard for our building ordinances, and permit process. There was 100% land coverage, height and setback requirements on the fence, and lastly, no applications to my knowledge have been issued...

Yours faithfully,

Dear Liz Kroll,
Liz, Permit #18-00022, I'll need to see the applicants sealed survey as part of the application. The replace means with same, and if modified where new post and boundaries are located, an application needed to go before the zoning board. I also don't see an electrical application .
I see Permit #07-00303 was for a 30' x 32" walkway in back of house, which doesn't appear to be an issue... What is an issue, and what people within the building department were made aware of, is that the owner has 100% paver coverage in the rear yard. I would like to see if there was ever a permit issued, and who approved it. I also see a partial application dated 4/20/2020, which is after the fact, and my question is, are there any fines or violations presently sited. I would also like to see the site plan / survey that was submitted with this 4/20 application, and if it's under review, or being sent to the Zoning Board...
There are several violations and I would like to see the building inspectors comments, and or approvals.. According to Township Ordinances, I see several violations. (Height, Setbacks, Coverage, Electric, & side yard, front of house, underground plumbing). Thanks Liz...

Dear Liz Kroll,
Regarding 55 Chestnut, I see that the inspector just questioned the coverage. My concern is the setbacks for a corner property, fence heights and locations, and lastly, underground electric to concrete columns... There should be more violations, and they need to be addressed.. BTW, I know this isn't part of this action, but nobody can get agenda's on the township site, 10 days in advance, plus the board members aren't getting their packets in the same time span, as required...

Dear Liz Kroll,
Liz, waiting till the 15th to see if the property was corrected, and if other violations are forthcoming. The inspector just addressed coverage, but as I stated in several prior notifications, he has fence heights, setbacks, and underground electrical to the columns, plus underground water diversion, where too, unknwn..

I have been advised that this is an on-going issue being addressed by the part-time Construction Code Official and part-time Building Sub Code Official. As it is being reviewed if necessary summonses will be issued. Currently this is all the information available. Elizabeth Kroll - Clerk

Dear Liz Kroll,
Liz, May 18 was the building departments letter to the resident, stating one of the many violations. The resident had till June 18 the rectify the problem, and as of July 22nd, nothing has been done.. Before I send this in for an investigation, I would like to know the status. (If Other Violations were cited, fines levied, and disciplinary action being taken by the building dept.). The building dept. not only has a coverage issue, but set backs, fence heights, and electricity to the columns... As I mentioned, I will hold off on asking for an investigation, until I hear back from the building dept..

As of today, the Construction Code Official spoke with the property owner whose engineer will be submitting his coverage calculations within the week. Once received the Code Official will review and determine if a variance is required. Elizabeth Kroll - Clerk

I spoke with Anthony Laface and his engineer will be submitting his coverage calculations within the week. Once this is received we will review and determine if a variance is required.

Dear Liz Kroll,
This has been going on for over 4 months, and I would like to know, why our inspector needs clarification from the applicants engineer. The other fact to consider is, all this work was done without a single permit, and under the noses of local officials, who never spoke up... I wasn't provided this same luxury when I built my legal porch, and even after providing our ordinance to the zoning officer, plus getting verification from our board attorney... Sorry but I can't rely on an honest and impartial answer to my request, and it might be better to have an independent investigation if a reasonable response isn't forthcoming...

Dear Liz Kroll,
Liz, building inspector called and told me that, if he didn't have something from the homeowner by 8/28/2020. a fine was to be issued, and further action warranted... I would like to know if those actions were taken...and I would like a copy of the letters and fines issues to the homeowner..

Dear Liz Kroll,
Jim, thanks for the reply on 55 Chestnut, and the personal phone calls to me. I am closing out my OPRA, but I must tell you this, some local builders, and quite a few residents are concerned about you taking the letter from the applicants engineer, without a site visit, and calculations done by you.. This has been followed by many, and they are concerned about how the community is severely changing, and not for the better.
Once again, thanks for a copy of your letter, and hope you look into this further.

Yours sincerely,
