This correspondence is in response to a request you made under the Open
Public Records Act, dated May 5, 2020, wherein you have requested:

“All pleadings and information submitted by or received by the League of
Municipalities to the Council on Local Mandates in In the Matter of A
Complaint filed by Deptford Township, Council on Local Mandates decided
on April 20, 2016.” And;

Request 2
“All pleadings and information submitted by or received by the League of
Municipalities to the Council to the Council on Local Mandates in In the
Matte of A Complaint filed by Ocean Township (Monmouth County) and
Frankford Township (August 2, 2002).”

In regards to Request 2, the records you have requested may not be in
the League’s possession.  The records you request pertain to a matter the
League was involved in prior to the 2011 NJ Supreme Court Decision that

interpreted the League to be subject to the Open Public Records Act, (see,
Fair Share Housing Center, Inc., vs. NJ State League of Municipalities, 207
N.J. 489, (2011)).  While it is possible that these records are available, my
ability to search for documents responsive to your request is constrained
by the realities of the current COVID-19 pandemic.  Due to the pandemic I
am working remotely and, while I have access to electronic files, my
access to physical files is limited.  I will be making arrangements to search
the physical files in storage but at this moment cannot give a timeframe
for when this can be achieved.  Once I have the opportunity to search
these files I will respond with a definitive response to your request.

I joined the webinar & answered the questions…(left a message that something odd happened

when answering the first question and hoped it registered), but I have not received the CEU
Certificate.

I haven’t previously experienced any issues with receiving correspondence for webinars.  I
received the May 7, 2020 email: “Subject: Ask OPRA-We Need Your Questions” (below), so it appears
the system knew I was registered.

Maybe my email address is misspelled somewhere?  Can you please check into this and also
send me the CEU Certificate and PowerPoint presentation?

My assistant asked the following:  1. How long do we have to wait before closing out a request for an
On-Site review once the requester has been notified that the documents are ready?  Sometimes they
never respond or show up to do review of records.
