1. OPERATION OF THE MOTOR VEHICLE:
1. Operation of the motor vehicle:
On Monday December 28, 2020 I was assigned to a Driving Under the Influence enforcement detail within Lower Township.
At approximately 2105 hours, members of the on duty patrol squad, specifically Officer Aiken and Patrolman Craig, were
dispatched to the area of the 100 block of Bayridge Road in the North Cape May section of Lower Township for a reported
occupied suspicious vehicle. Upon their arrival they observed a white Nissan Altima bearing New Jersey registration
H75LHW parked on Bayridge Road. The two officers made contact with the driver, John A. Chew (DOB:
) who
was seated in the vehicle's driver seat with the engine running.
2. When Stopped:
Knowing that I was on a specifically assigned Driving Under the Influence detail, my response was requested. Upon my
arrival I approached the driver's side door of the vehicle and immediately identified the driver as John A. Chew. As I began
to speak with Chew, it was quickly noticed that he was slurring his speech, his eyes were red and watery and his
movements were slow. I asked Chew how long he was sitting in his car at that location and he stated a 'half hour'. I could
also detect the odor of alcohol emanating from the vehicle through the open driver window. I asked him how much he had
to drink and he stated, "ummm I'd say less than zero." Chew asked me several times to just take him home to
or to follow him home.
I opened the driver door in an attempt to have Chew exit his vehicle. Several times he asked me to close the door which I
did not. I asked Chew if he was in need of medical attention or if he was having a medical episode and he stated he was
not. He continued to ask me to close his door. Chew was seated in the driver seat of his vehicle with no shoes on, but with
white socks. His shoes were on the floor board. After sevreral attempts, I was able to convince him to exit the vehicle. I
assisted Chew in putting his shoes on, because he was unable to by himself.
When he eventually exited the vehicle, he had trouble standing. As he walked to the rear of his vehice, he put his hand out
for balance against the vehicle. I was explaining to Chew that I wanted to explain tests to him to complete at which point he
leaned against the trunk of his vehicle. I asked him if he had any pain in his lower extremeties and he said "all of it." Chew
went on to state he has pain from 'the bottom right to top left.' I asked him to explain what he meant and he said from his
bottom right foot to his top left. I asked him to not lean on his vehicle and he stated he can't because hes in total pain.
I asked Chew how much he had to drink and he said he hasn't had anything in the last seven hours. Chew again pleaded
with him to give him a ride home. I decided for the safety of Mr. Chew because of his obvious intoxication that I would not
be running him through Standard Field Sobriety Testing. I then told Chew he was going to be placed under arrest. I placed
him in handcuffs, which were placed in front of him due to
. Patrolman Craig radioed Cape
May County Communications explaining that we had Mr. Chew under arrest and requested a tow to impound the vehicle
purusant to John's Law. Cape May County Communications advised Eddies Auto Body was enroute to tow the vehicle.
3. Enroute to Station:
Chew was escorted back to a marked patrol unit where he was secured for transport to police headquarters.
Two bottles of Svedka Vodka, one empty and one partially gone were observed on the floor in front of the driver seat. A
third bottle was located in the vehicles center console, which was also open with an amount of vodka missing. I
photographed the bottles in place and seized them.
The Svedka bottles were placed in my vehicle and transported to police headquarters for destruction. Once at the Lower
Township Police Department, I again photographed the bottles and disposed of them.
4. At Station:
When Officer Pat Aiken arrived at police headquarters with Chew, he passively refused to exit the patrol vehicle. After

several attempts over a period of time, he finally exited the patrol vehicle and was guided into the processing room.
Patrolman Jordan Saini was assigned to run the Alcotest. See Patrolman Saini's supplemental report for details.
After a control test failure, Chew was transported by myself and Ptlm. Saini to the Cape May City Police Department for a
chemical breath test utilizing their Alcotest Machine. After Chew gave two sufficient breath samples, the Alcotest indicated
a reading of .33% BAC. The results as well the the New Jersey State Police calculator are a permenant fixture of the case
file.
Based on the reading being at an unhealthy, unsafe level, John Chew was transported by a Cape May City Fire Department
ambulance to Cape Regional Medical Center for medical attention.
5. Traffic Offenses:
Subsequent to the investigation, John A. Chew was issued motor vehicle summons number A-067741 for a violation of
39:4-50 Driving Under the Influence and summons number A-067742 for a violation of 39:4-96 Reckless Driving.
John A. Chew was served his summonses at Cape Regional Medical Center where was being evaluated.
Body worn camera (BWC) as well as the motor vehicle recorder (MVR) videos were requested to be downloaded and
burned onto a DVD. The DVDs were logged into the B.E.A.S.T. Evidence system pursuant to departmental procedure.
